These terms are an agreement between you and Scribby (“Scribby”, “we”, “us”) for the use of the Scribby app and the thescribby.app website (together, the “Service”). By creating an account or using the Service you accept them. Please also read our privacy policy, which explains how we handle your data.
1. What Scribby is
Scribby delivers one curated inspirational quote a day, personalized to your language and preferences, with streaks, folders, sharing, widgets, and notifications built around that daily ritual. Quotes are offered for reflection and inspiration only. They are not professional, medical, psychological, financial, or legal advice, and they are no substitute for it.
2. Who can use it
You must be at least 13 years old to use Scribby, or older if the law where you live sets a higher minimum age for consenting to the processing of your data. If you are a minor, you need your parent’s or guardian’s permission.
3. Your account
You sign in with Sign in with Apple. You are responsible for keeping access to your Apple account secure and for what happens under your Scribby account. One account is for one person. You can delete your account at any time in the app’s settings; deletion is immediate and permanent.
4. Scribby+ subscriptions
Parts of the Service (for example folders, widgets, the full icon and theme sets, and the extended quote library) require a paid subscription called Scribby+.
- Billing. Subscriptions are billed to your Apple account through the App Store. Prices are shown in the app before you subscribe and may vary by region.
- Auto-renewal. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple account is charged for renewal within 24 hours before the period ends.
- Cancelling. You can cancel anytime in your device settings under your Apple account’s subscriptions. Cancelling stops the next renewal; the current period keeps running until it ends.
- Free trials. If a free trial is offered, its length and price after the trial are shown before you subscribe. Any unused trial time is forfeited when you buy a subscription. If you do not cancel at least 24 hours before the trial ends, the subscription starts automatically.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple under their terms. You can request one at reportaproblem.apple.com.
- Price changes. If a subscription price changes, we will notify you in advance as required by the App Store, and the change only applies to renewals after the notice.
5. Your content
Folder names, folder icons, a profile picture, and feedback you send are yours. By adding them to the Service you give us a non-exclusive, worldwide license to host, store, display, and process them, only as needed to run the Service. Do not upload images or text that are unlawful, hateful, sexually explicit, or that infringe someone else’s rights. When you share a folder, the people you invite can see that folder’s name, icon, and quotes.
6. Our content
The Service, including its design, mascot, wordmark, software, and curated quote collections, belongs to Scribby or its licensors and is protected by intellectual property laws. Individual quotes remain the work of their respective authors where copyright applies. We grant you a personal, non-transferable, non-exclusive, revocable license to use the app on Apple devices that you own or control, for personal, non-commercial purposes. Share cards you create are meant for personal sharing; do not use them commercially without our permission.
You may not copy, modify, distribute, sell, or lease any part of the Service, scrape or bulk-export its content, reverse engineer the app except where the law expressly allows it, or use the Service to build a competing quote dataset.
7. Acceptable use
Do not misuse the Service: no unauthorized access attempts, no interfering with its operation, no abusing folder sharing or feedback to send spam or harassment, and no automated access without our written consent. We may suspend or terminate accounts that break these terms, after warning you where that is reasonable.
8. Availability and changes
We work on Scribby continuously and the Service will change over time: features may be added, altered, or removed, and the quote library evolves. We may interrupt the Service for maintenance or updates. We do our best to keep Scribby available but do not guarantee uninterrupted, error-free operation.
9. Termination
You can stop using Scribby and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, if we are legally required to, or if we discontinue the Service; where the law requires it, active paid periods are handled through Apple’s refund process. Sections that by their nature should survive termination (5, 6, 10, 11, 13) survive.
10. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits warranties or guarantees that applicable consumer protection law grants you and that cannot be contractually excluded.
11. Limitation of liability
To the extent permitted by law, Scribby is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising out of your use of the Service. Our total liability for claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot be excluded by law.
12. Apple App Store terms
These additional terms apply because Scribby is distributed through Apple’s App Store:
- These terms are between you and Scribby only, not with Apple. Apple is not responsible for the app or its content.
- Your license to the app is limited to a non-transferable license to use it on Apple-branded devices that you own or control, as permitted by the App Store terms of service.
- Scribby, not Apple, is responsible for maintenance and support, for handling any product, legal, or regulatory claims relating to the app, and for addressing claims that the app infringes third-party intellectual property rights.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- You represent that you are not located in a country subject to a US government embargo or designated as “terrorist supporting”, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Governing law
These terms are governed by the laws of Germany, excluding its conflict of law rules. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected, and you may bring claims in your local courts.
14. Changes to these terms
We may update these terms as the Service evolves. For significant changes we will notify you in the app or by email before they take effect. If you keep using Scribby after the changes take effect, the updated terms apply. If you do not agree with a change, stop using the Service and delete your account.
